U.S. Department of Commerce launches "232 investigation" on mobile crane imports


On May 6th, US Secretary of Commerce Ross announced that the US Department of Commerce will launch a "232 investigation" on whether the quantity and status of mobile crane imports harm US national security.


The U.S. Department of Commerce said the investigation was initiated on the basis of a complaint by the U.S. crane manufacturer in December last year. The company said that the increase in imports of low-cost mobile cranes (especially from Germany, Austria and Japan), as well as intellectual property violations caused by foreign competition, has hurt the domestic mobile crane manufacturing industry in the United States. In view of the wide application of mobile cranes in the defense and critical infrastructure industries, the United States has identified it as a key industry.


According to Article 232 of the US Trade Expansion Act of 1962, the US Department of Commerce has the right to initiate investigations on whether imported products harm US national security. Earlier, the US government launched a "232 investigation" on imported steel and aluminum products, automobiles and spare parts, uranium ore, sponge titanium, etc., which was widely opposed by the domestic and international communities.


Secretary Ross said: "We will conduct this review thoroughly and quickly. This investigation will help determine whether the amount or condition of the import of mobile cranes is likely to harm US national security."


Manitowoc claims that the increase in imports of low-cost mobile cranes imported from Germany, Austria and Japan and foreign competition infringing intellectual property rights have damaged the US mobile crane manufacturing industry. Given that mobile cranes have been widely used in defense applications and critical infrastructure areas, the Department of Homeland Security has identified mobile cranes as a key industry.


Manitowoc said that low-cost imports and intellectual property infringement caused one of its two US production facilities to close and laid off hundreds of skilled employees in Wisconsin. Citing data from the US International Trade Commission (USITC), Manitowoc pointed out that the imports of mobile cranes increased by 152% from 2014 to 2019; in 2015, the US International Trade Commission 337 investigation ruled that China Sany Heavy Industry infringed its patent rights and six Trade secrets, and implement a ten-year limited exclusion order prohibiting the import of cranes and parts.


In July 2013, at the request of Manitowoc, the US International Trade Commission initiated a 337 investigation on the crawler crane products of China Sany Heavy Industry Group and its US company. Manitowoc accused Sany Heavy Industry of the above-mentioned products and components sold in the United States for infringing its patents and demanded the issuance of an exclusion order and an import ban order. After USITC's ruling, Sany Heavy Industry appealed, but the 2016 Federal Circuit clearly confirmed the USITC's order.


Many US trade experts believe that the frequent use of the "232 investigation" by the United States as an outdated unilateral trade protection tool seriously disrupts the international trade order and violates the rules of the World Trade Organization.
